Legal aid in criminal cases
Two tests decide whether you qualify
To be granted legal aid in the Magistrates' Court you need to pass two tests. We can advise you whether legal aid is available, whether it is suitable for your case and whether we can act for you on a publicly funded basis.
The interests of justice test
This looks at how serious your case is for you — for example if:
- you might lose your job
- you might go to prison
- you find it difficult to understand the proceedings because of language issues or mental health
The means test
This looks at your disposable income. You should qualify if you are under 18 and in full-time education, or receive Income Support, Jobseeker's Allowance or a State Pension. If you are working you may still qualify.
- Disposable income should not exceed £283.00 per month
What legal aid does not cover
Legal aid is not available during the investigation stage, save for attendance at an interview under caution. It does not cover preparation for the interview or work after it — arguably the most important stage of a case. In some cases it may not be economically viable for us to act on a legally aided basis.
Recovering your costs
If we successfully defend your case at court, we will seek a defendant's costs order. Your file is then submitted to the National Taxation Team, who decide what proportion of your costs will be refunded.
The small print
- All of our criminal and general private fees attract VAT at 20%, and all disbursements attract VAT at 20%.
- Immigration fees are shown excluding VAT. We will tell you if VAT is payable in your case, as some cases are not subject to VAT.
- Our private fees, whether fixed fees or hourly rates, do not include disbursements (payments to third parties) such as barristers' fees, experts' fees, court and Tribunal fees, Home Office fees or translation fees.
- The ranges shown are typical. Depending on the type of case fees can exceed them, and where this occurs we will advise you before any further work is done.
