AGI Criminal Solicitors Limited ("we", "us", "our") of 429 Chester Road, Old Trafford, Manchester, M16 9HA is committed to safeguarding the privacy of everyone whose personal data comes into our possession, including visitors to www.agicriminalsolicitors.co.uk and our clients. We process personal data in accordance with the UK General Data Protection Regulation and the Data Protection Act 2018.
1. Personal data we collect
We will collect your name, address, telephone numbers, email address, date of birth, information to verify your identity (such as passport details), information about the matter on which you seek our advice or representation, and financial details so far as they are relevant to your instructions or to legal aid.
Depending on your matter we may also collect your National Insurance and tax details, bank details, employment and benefits details, details of family members, your nationality and immigration status, and special category data such as your racial or ethnic origin or medical records. We will only process special category data with your explicit consent or where the law otherwise allows.
2. How we collect your data
We collect most information directly from you. We may also receive it from publicly accessible sources, from the police, prosecuting authorities and other enforcement bodies, from third parties with your consent (such as doctors, experts or other professionals instructed on your matter), via our website and cookies, and via our IT, case management and communications systems.
3. How and why we use your data
- to provide legal advice and representation;
- to verify the identity of our clients and assess eligibility for legal aid;
- to comply with our professional, legal and regulatory obligations, including those of the Solicitors Regulation Authority and the Legal Aid Agency;
- to respond to audits, enquiries or investigations by regulatory bodies, including external quality audits such as Lexcel;
- to keep our systems secure, update client records, train staff and manage our practice;
- to send updates you have subscribed to (you can unsubscribe at any time).
We process your data because it is necessary to perform our contract with you (or to take steps at your request before entering into one), to comply with our legal and regulatory obligations, or where you have given your consent.
4. Who we share your data with
We keep client information strictly confidential. We share it only where necessary to act for you or where required by law — for example with barristers instructed on your behalf, the courts, the Crown Prosecution Service, the Legal Aid Agency, the Home Office, experts such as medical consultants, and our regulators. Our service providers, such as IT contractors, may only handle your data under contractual obligations to protect it. We will not share your data with any other third party without your specific consent, and we never sell personal data.
5. Where your data is held and for how long
Your data is held at our offices and by our service providers. On rare occasions, for example where you are based abroad or your matter has an international dimension, it may be necessary to transfer data outside the UK; we will advise you on a case-by-case basis and apply the safeguards required by law.
We keep personal data after our work for you has finished so that we can respond to questions, complaints or claims, show that we treated you fairly and keep records required by law. In general we retain electronic material for six years, after which it is deleted or anonymised.
6. Keeping your data secure
We have appropriate security measures to prevent personal data from being accidentally lost, used or accessed unlawfully. Access is limited to those with a genuine business need, who are subject to a duty of confidentiality. We have procedures to deal with any suspected data security breach and will notify you and any applicable regulator where we are legally required to do so.
7. Your rights
You have the right to be informed, to access your data free of charge, to rectification, to erasure, to restrict processing, to data portability, to object, and rights in relation to automated decision-making and profiling. To exercise any of these rights, please contact Yasmin Aslam by emailing info@agicriminalsolicitors.co.uk, calling 0161 226 2070 or writing to us at 429 Chester Road, Old Trafford, Manchester, M16 9HA, with proof of your identity and address and details of your request. If you are unhappy with how we handle your data, you may complain to the Information Commissioner's Office at ico.org.uk/concerns or on 0303 123 1113.
8. Changes to this policy
AGI Criminal Solicitors may update this privacy policy from time to time. The current version will always be available on this page, and if you have an ongoing matter with us we will tell you about any significant changes.
